LI Quanxi
2023, 39(3): 239-245. doi: 10.19979/j.cnki.issn10082689.2022120029
Abstract(392) HTML (194) PDF(65)
Abstract:
The proposition of “the world significance of Xi Jinping’s thought of ecological civilization” is actually concerned about three aspects: “why does Xi Jinping’s thought of ecological civilization have the world vision”, “what kind of world implication does Xi Jinping’s thought of ecological civilization have” and “what kind of world contribution does Xi Jinping’s thought of ecological civilization have”. Therefore, to deeply understand the world significance of Xi Jinping’s thought of ecological civilization, we need to grasp its world vision from its generation logic, its world implication from its connotation system, and its world contribution from the process of global governance.
Rethinking the Nature of Young Marx’s Future Social Theory-Response to Three Key Issues
YANG Yufan, GUO Huiqing
2023, 39(3): 246-252. doi: 10.19979/j.cnki.issn10082689.2022060073
Abstract(309) HTML (167) PDF(32)
Abstract:
The outlook on future society in Marx’s early works is the primary form of scientific socialism. The outlook on future society expounded from a philosophical perspective is not “immature” or “unscientific”. The classic works of Marx in the middle and later periods also demonstrate the theory of future society from a philosophical perspective. In early works such as A Contribution to the Critique of Hegel’s Philosophy of Right Introduction and Economic & Philosophic Manuscripts of 1844, Marx used economics to demonstrate the historical mission of the proletariat, the class contradictions between the bourgeoisie and the proletariat, and the essence of exploitation in capitalist society. The theory of surplus value is not the only condition for the formation of scientific socialism. It is not advisable and unfair to take it as the fundamental standard to determine the nature of Marx’s future social outlook.

2023, 39(3): 253-258. doi: 10.19979/j.cnki.issn10082689.2023020081
Abstract(478) HTML (230) PDF(36)
Abstract:
To improve the humanistic qualities of college students in science and engineering colleges in the new era is an intrinsic requirement for implementing the fundamental task of cultivating virtue and cultivating people, the concrete embodiment of promoting the collaborative education of new engineering and new liberal arts, and the due meaning of realizing the all-round development of contemporary college students. However, the neglect of humanities under the concept of science and technology fundamentalism has a long history, coupled with the biased philosophy of science and engineering colleges, the imbalance of discipline construction structure, the insufficient construction of humanities teachers, and the relevant cognitive bias of teachers and students, which is not conducive to the improvement of college students’ humanistic literacy. Therefore, it is necessary to enhance ideological understanding and improve the institutional mechanism of humanistic literacy education; optimize the discipline system and promote the coordinated development of new engineering and new liberal arts; strengthen the construction of teachers and improve the comprehensive quality of teachers; improve students’ recognition, enhance self-cultivation ability, etc.; and to effectively improve the humanistic qualities of college students in science and engineering colleges.

JIAO Lei
2023, 39(3): 259-266. doi: 10.19979/j.cnki.issn10082689.2022110067
Abstract(514) HTML (214) PDF(24)
Abstract:
To build an independent knowledge system of philosophy and social science with Chinese characteristics, it is crucial to support the localization and globalization of Chinese comparative political study. Research on comparative politics in China has gone through two stages: “spontaneity” and “self-reflection”, and the third step, “self-renewal”, will be the next. It is impossible to ignore that the fundamental role of localization is to remodel theories, and the role of globalization is to take part in the reproduction of the global knowledge system. Chinese comparative political studies must be built on localization, integrate the local with the global, and advance the knowledge iteration of comparative political studies in the globe because the liberal democratic models of Europe and America and their knowledge systems cannot match the needs of China and other developing nations for growth.

WANG Yafeng, YU Guodong
2023, 39(3): 267-276. doi: 10.19979/j.cnki.issn10082689.2022110092
Abstract(367) HTML (115) PDF(30)
Abstract:
Parent/Child interaction as a type of talk-in-interaction is fundamentally a participant-produced interactive achievement. Taking video recordings and transcripts of parent/kid interactions from four families as its data, and integrating Conversation Analysis (CA) with Membership Categorisation Analysis (MCA), we propose to understand categorisation as constructed by social actions. Data analyses show three relation pairs, namely, guardian/kid, friend/friend, and teacher/pupil, are co-constructed and oriented to by relevant parties with social actions executed at specific sequential positions by parents and children, evoking three different member categorisation devices. This research not only innovates MCA studies, but also showcases the necessity and possibility of integrating CA with MCA. Research findings have deepened our understanding of parent/child interaction and might be applied in social practice.

DONG Boyu
2023, 39(3): 277-288. doi: 10.19979/j.cnki.issn10082689.2022110093
Abstract(386) HTML (201) PDF(25)
Abstract:
Repair is not only an interactional mechanism, but also a common communication phenomenon, which mainly functions as maintaining the progressivity and intersubjectivity in the interaction. Based on the naturally occurring family videos of four children (aged 2.6−5.5), the paper describes the mechanism of child referential repair initiated by the adult from the conversation analysis perspective. The results show that the trouble source of referential repair center on the dislocation of pronoun and the omission of pronoun in the action initial position. Open class repair initiation, category-specific repair initiation, and candidate understandings repair initiation are employed by the adult. Replacing and repetition with gestures are the basic repair solution adopted by the children. Though the preschool children are still in the process of language acquiring, they are competent in locating the trouble source and employing linguistic and embodiment resources to solve the intersubjective problem caused by the referential problem.

LIU Qinyu, WU Yaxin
2023, 39(3): 289-298. doi: 10.19979/j.cnki.issn10082689.2022110091
Abstract(299) HTML (255) PDF(30)
Abstract:
Parent-child interaction is a key site for children’s socialization. Mainly based on the macro-sociological perspective, existing research on parent-child interaction has not paid sufficient attention to the minute details of the interaction. To further explore child socialization in family, the current study has conducted a multi-modal conversation analytic study on child-initiated directive sequences, investigating how children initiate directives, how parents respond, and what are oriented to by both parties. It is evidenced that children can take the contingency of parents’ compliance into consideration and design their directives correspondingly. Besides, cross-cutting preferences are noticed in parents’ responses due to their orienting to several contradicting social norms. As for children’s socialization, instead of passively being socialized, children indeed, together with their parents, actively practice socialization in parent-child interaction.

Abstract(342) HTML (183) PDF(27)
Abstract:
Under the background of the new era, China’s felony prosecutorial work has ushered in opportunities and challenges. On the one hand, felony prosecution is an important way to safeguard our national security, especially political security. On the other hand, in the judicial practice, the procuratorial work of felony faces some difficulties, such as unclear premise of substantive law, limited scope of applicable cases, high difficulty in proving some cases and unclear operation mechanism of felony consultation. It also faces many challenges brought by the change of the background of criminal law governance in the risk society, the expansion of the object of protection in the context of criminal substantive law, the tension of value relationship in the dimension of criminal procedure law and the network of crime scenes. In order to respond to the requirements of the balance between the value of security guarantee and the value of freedom protection put forward by the overall concept of national security in the criminal field. The response ideas of felony prosecution in the new era should start from the two aspects of theoretical paradigm and practical path, and combine the guiding concept, the aspect of substantive law, the aspect of procedural law, and the four aspects of case handling mechanism. Thus can we really promote the modernization of our felony procuratorial business.

LEI Da, ZHENG Xujiang
2023, 39(3): 310-319. doi: 10.19979/j.cnki.issn10082689.2022080012
Abstract(383) HTML (134) PDF(33)
Abstract:
Personal information has become one of the most valuable resources in the 21st century. The illegal use of citizens’ personal information has become the focus of the current criminal law governance. In judicial practice, the phenomenon of mixing personal information and related concepts has become the norm, which affects the understanding of the constitutive requirements of the crime of infringing citizens’ personal information and the scope of punishment. As the object of the crime of infringing citizens’ personal information, “personal information” is an inevitable product of the convergence of criminal and civil norms. Therefore, we should try to interpret the concept of “personal information” under the guidance of the principle of unity of legal order: in the form, based on the provisions of the Civil Code, we should adopt the concept of personal information in a narrow sense, and strictly distinguish the relationship between personal information, personal data and privacy; in essence, we should deeply grasp the legal core of the crime of infringing citizens’ personal information. As the object of this crime, personal information should fully reflect the legal nature of the right to self-determination of personal information, and provide a solid foundation for the realization of the right to choose and decide.

HAN Xiao
2023, 39(3): 320-329. doi: 10.19979/j.cnki.issn10082689.2022080064
Abstract(266) HTML (146) PDF(27)
Abstract:
Wrongful convictions hinder the realization of the goal of justice in criminal trial, which is the negative consequence of judicial operation deviating from justice. By interpreting the deviation and return of judicial justice, it reveals that the failure of substantive justice may occur under any litigation system because of the limitation of lawsuit cognition and evidence judgment, but the obstacles to the realization of procedural justice can be eliminated by means of institutional perfection. In the two typical structures of modern criminal procedure, the United States criminal procedure system is regarded as the classic paradigm of adversary system because of its highly developed due process. However, there are still a large number of wrongful convictions. Exploring the institutional efforts made by the United States in the management of wrongful convictions can provide inspiration on the reform path of reducing judicial injustice in our country. To solve the wrongful conviction cases, it is necessary to rely on the systematized governance method, and build a complete mechanism to find and correct wrongful convictions, so as to relieve the wrongful judgment in a large scale, organized and systematic way. Meanwhile, it is also indispensable to adhere to the “dynamic equilibrium” concept of criminal procedure, and the improvement of criminal procedure system should balance substantive justice and procedural justice, so as to prevent the untimely occurrence of unjust cases.

2023, 39(3): 353-361. doi: 10.19979/j.cnki.issn10082689.2023010045
Abstract(192) HTML (285) PDF(31)
Abstract:
Through the analysis of the news, illustrations and advertisements about typists in the mass press during the Republican period, combined with the relevant archival historical materials, it is found that there were two kinds of contradictory images about female typists in the mass press at that time. The positive one thinks female typists are competent and independent, but the negative one compares them to “eye candy” and even “delicate wife”. The positive images show that the social needs and economic development, the rise of female education and women’s liberation encouraged women to actively walk out of the family and into the society, while the negative images implied that the strong inertia of the old concept of gender division of labor and the patriarchal culture anxiety. The coexistence of these two kinds of images reflects the characteristic of the blending of the new and old ideas of gender division of labor in the period of social transformation.
