Abstract

Abstract

Acurding to the theory of Separability of Arbitration Clause, arbitration clause is a dispute-resolution-clause subordinatied to commercial contract, it is independent. The effect of arbitration clause is not related to main contract. The theory of Separability of Arbitration Clause comes from arbitration practice; it contains the respect to the parties; will and a clear understanding of the arbitration agreement's nature.
