2019, 35(1): 1-7.
Abstract(372) PDF(10)
Abstract:
In the paper an approach of register analysis based on conceptual mapping model is designed to compare WAR metaphor use in business discourse and health discourse. It is found that the latter uses more, more dynamic and more specific metaphors on the linguistic level. On the conceptual level,WAR metaphoric mapping in the former highlights the strategic nature of wars while that of the latter, the suddenness and violence of the war process. On the communicative level, WAR metaphoric mapping in the former conveys the evaluative meaning{Neutral:Affect——Desire}while that of the latter, the evaluative meaning{Negative:Judgment——Danger}.The register analysis under discussion reveals register differences through comparing metaphoric mapping on the linguistic, conceptual and communicative levels.

KUANG Zhan, LI Shu-jing
2019, 35(1): 8-15.
Abstract(283) PDF(3)
Abstract:
Based on the empirical research and a small self-built corpus, the paper attempts to explore generic structure of the psychiatrist-psychopath institutional conversation and its functional varieties from genre theories of Systemic Functional Linguistics. The research results reveal a four-stage structure mark:orientation^medical history collection and professional inspection^diagnostic statements and treatment recommendations^coda. In the lexical-grammatical realizations, this structural potential can be achieved through a mixing of discourse patterns.Among which some are congruent and others metaphorical. While representing the characteristics of the psychiatrist's repertoire and genre identity, they also reflect the psychiatrist's genre purposes in specific context.

JIN Huai-mei
2019, 35(1): 44-49.
Abstract(340) PDF(5)
Abstract:
There has always been a consensus among the critics that J.M.Coetzee'works are intellectually anchored in the cultural metropolis of Europe and the United States, and they also belong to South African literature. Thus the correlation between his works and Chinese culture has never been covered. In fact, however, many of his writings have touched upon China or Chinese elements more or less, and Coetzee himself has really known what Chinese culture and even ancient China were.We readers can even dig out the relation of Coetzee with Confucian culture from his biography. The present paper attempts to exploit the relation with the focus on humanism on penalty concept and Great Harmony thought in the writer's works which are in line with Confucianism, revealing his multicultural thought as well as the universal significance of Confucianism.

Hong Shuzu in Song Jiaoren's Case——Concurrently Discussing the Retrial of Song Jiaoren's Case by Shang Xiaoming
ZHANG Yao-jie
2019, 35(1): 56-65.
Abstract(521) PDF(41)
Abstract:
Hong Shuzu, who was involved in Song Jiaoren's case, was a senior official in the Ministry of Interior. In the course of performing his duties, he colluded with Ying Kuicheng to take a large sum of money from the central government. Even in the name of the central government, especially by utilizing Yuan Shikai and Zhao Bingjun, Hong Shuzu encouraged Ying Kuicheng by means of secret letters and telegraphs to implement the action plan for the murder of Song Jiaoren. This directly contributed to the bloody murder of Song Jiaoren in Shanghai. As a result, he was derelict in his duties and perverted the law and even instigated the murder. However, Hong Shuzu and Ying Kuicheng, who had a unidirectional contact with Hong, did not appear at the scene of the murder. Wu Naiwen and others who appeared at the murder scene to command Wu Shiying to commit the murder had arranged in advance for Wang Afa, under the guise of an antique dealer, to report Ying Kuicheng. In the book"Retrial of Song Jiaoren's Case", Shang Xiaoming neglected the eyewitness testimony. Only through fragmented and contradictory data did he identify Hong Shuzu, who had a special relationship with Yuan Shikai, as being the sole prime culprit of Song Jiaoren's case. In fact, there is no tangible and complete evidence at the academic level, which therefore is inconclusive.
Study of the Order Arrangement for China by the Yalta Secret Agreement: Based on the Angle of Chiang,His Son and Eden's records
ZHANG Shao-dong
2019, 35(1): 66-72.
Abstract(292) PDF(10)
Abstract:
From February 4 to 11, 1945, the United States of America, the Soviet Union and Great Britain held a summit in Yalta to arrange the international order and divide up their interests of post-World War II.At the Yalta Conference,The United States, the Soviet Union and Great Britain signed a secret agreement. It met the Soviet's demand for a privilege in northeast China. The United States and Great Britain also obtained their respective interests in China. In exchange, the Soviet Union agreed to enter into the war against Japan after the war terminated in Europe.Chiang kai-shek's Diaries,Chiang ching-kuo Readme and the Memoirs of Eden all included details about the violation of China's sovereignty by the secret Yalta agreement. These accounts showed that under the pressure of the US-Soviet power politics, China and the Soviet Union continued to negotiate, leading to the Soviet Union obtaining more benefits than the Yalta Secret Agreement. This is a serious violation of Chinese sovereignty caused by the US-Soviet power politics. The establishment of New China led to a partial end to the Agreement, gradually removing the destiny of arbitrary manipulation by Western power politics. Now China has become an influential power in the world, puts forward the vision of a community of shared future for mankind in international relations, staking out a completely different path from that of Western power politics. However, the influence of Western power politics is deeply ingrained in the current relations. Many obstacles still need to be overcome in order to realize the community of shared future for mankind.

Research on the Countermeasures of Procuratorate Reform across Administrative Divisions in China
LIU Jue, YAN Ze-min
2019, 35(1): 80-88.
Abstract(423) PDF(7)
Abstract:
Beijing and Shanghai have become the pilots for the procuratorate reform across administrative divisions and have obtained important partial results. The scope of functional jurisdiction has been basically clarified;the handling of cases has been gradually standardized; the establishment of the institutions has constantly been scientific; the business talents have been constantly professionalized, and the working mechanism has been standardized on an ongoing basis. However, procuratorate reform across administrative divisions still faces bottlenecks such as unidentified legal status, lagging legislation, irrational hierarchical arrangements, unscientific case jurisdiction planning, and unclear institutional construction.Promoting and deepening the procuratorate reform across administrative divisions are also inevitable choices for practicing the spirit of the 19th National Congress of the CPC"to deepen the comprehensive reform of the judicial system and to fully implement the judicial responsibility system".In order to establish a procuratorate system across administrative divisions, it should be started from three aspects:defining the legal status, constructing the organizational system, and improving the management system. The reform can thereby create conditions for fully implementing procuratorate reform policies and promoting implementation of power across administrative divisions.
Commonality and Individuality: The Various Possibilities of a Lawyer's Thinking
CHEN Zi-pan
2019, 35(1): 89-97.
Abstract(253) PDF(3)
Abstract:
Thinking is a unique mental activity. The thinking of a lawyer includes the commonality and the personality of thinking, which stems from the professional character and essential attributes of a lawyer. The community of lawyers has a commonality in thinking because of professional skills and needs. However, the common thinking of a lawyer is not always effective in dealing with legal cases. The defects of common thinking leave room for the thinking personality of a lawyer which indicates that he or she will unconsciously include his or her own values when dealing with legal issues. The commonality and individuality of a lawyer is a dialectical unit. The benign interaction between the two is not easy, which may lead to wrong thinking, and must be corrected.Lawyerly thinking has significance in safeguarding the community's right to speak and promote professional specialization. However,a lawyer should avoid falling into the stereotype of thinking only in the benign interaction of commonality and the individuality of thinking.Constituting the thinking of a lawyer is an important path to deepening the construction of such thought.

Locke's Abstract Ideas: Name and Meaning
XIAO Fu-ping
2019, 35(1): 98-106.
Abstract(346) PDF(2)
Abstract:
In Locke's empirical world, the formation and expression of abstract ideas is inevitable, and the process of human experience is always accompanied by the existence of abstract ideas.Locke's concept of an abstract idea has its own position and content in one's thinking; it embodies reality as an abstract idea.It also holds the "name" of the reality in the use of natural language and conjures the semantic world.Establishing the relationship between name and reality is free and arbitrary,so the concept of an abstract idea in one's thinking and in the experience of language is not always the same.Names and reality of experience are not always based on necessary unity. In the sense of an abstract idea, the distinction and unification of a name and reality are only possible and realistic if we return to the world in which the rational subject exists.
Einstein's Outlook on Society
ZHOU De-hai
2019, 35(1): 107-118.
Abstract(360) PDF(3)
Abstract:
While studying and researching scientific theories, Albert Einstein usually acted like a historian or an archaeologist. He deeply understood the scientific theories through examination of the origin and evolution of scientific concepts. He asserted that the whole of science included all the branches of natural science and social science, history and historiography. He believed history and science hadn't only something in common but also had individual characteristics.Based on his personal experiences in studying scientific theories and history, he classified history into two types:internal(or intuitive) and external(proved by historical articles). But he displayed ideological inconsistency on the objectivity of history and science in that he didn't implement his scientific epistemology in studying history.According to Einstein's scientific epistemology, historical research could attain objectivity and truthfulness as much as scientific research could.
