The Legal Integration of Criminal Policy Sentencing Norms from the Perspective of Urging Voluntary Surrender Announcements

摘要: 敦促自首公告作为配合专项治理行动的特定刑事政策工具,兼具政策动员与规范引导功能,但在司法实践中面临规范地位不明与裁量隐形化的困境。该公告本质上是“宽严相济”刑事政策的具体表达载体,属于政策性量刑指引,其规范定位根据发布主体的不同也略有区别。中央层面的公告应界定为全国性政策指引规范,属于对既有量刑规范的细化,应当作为刑罚裁量的依据;地方层面为执行性细化参照规范,属于对中央层面公告内容的重申和细化,但不能独立作为刑罚裁量的依据,只能成为参照;个案层面则为受信赖保护原则约束的政策承诺。这些政策性量刑规范的具体内涵需要置于现行量刑规范体系中去理解,做到两者的协调。具体为 “限期投案”并非独立量刑情节,而是对法定自首从宽幅度的政策性再细化;“依法从严”是对自首从宽幅度的逆向限定与收缩,而非创设法外从重情节;“可以减轻处罚”的政策承诺应解释为“原则上减轻、例外仅从轻”的强效激励导向。通过这些法治化阐释,政策性量刑规范即被纳入可预期、可检验的裁量理由体系,实现治理效能与法治原则的统一。Abstract: The announcements urging voluntary surrender, as a specific criminal policy tool in special governance actions, serve both the functions of policy mobilization and normative guidance, but face difficulties in judicial practice due to unclear normative status and implicit discretion. Essentially, these announcements are a concrete expression of the criminal policy of “tempering justice with mercy” and belong to policy-based sentencing guidance, with their normative positioning varying slightly depending on the issuing authority. Announcements at the central level should be defined as national policy guideline norms, which are refinements of existing sentencing standards and should serve as a basis for sentencing discretion; at the local level, they act as execution-oriented detailed reference norms, serving as a reiteration and refinement of the central announcements' content, but cannot independently serve as a basis for sentencing discretion and can only be used as a reference; at the individual case level, they constitute policy commitments constrained by the principle of legitimate expectation. The specific connotations of these policy-based sentencing norms need to be understood within the current sentencing norm system, so as to ensure coordination between the two. Specifically: “Surrender within a time limit” is not an independent sentencing circumstance, but a further policy refinement of the statutory leniency for voluntary surrender; “strict in accordance with the law” is a reverse restriction and contraction on the scope of leniency for voluntary surrender, rather than the creation of an extra-legal aggravating circumstance; the policy promise that “punishment can be reduced” should be interpreted as a strong incentive guidance of “generally reduce, exceptions only mitigate lightly.” Through these legal interpretations, policy-based sentencing norms are incorporated into a system of discretionary reasoning that is predictable and verifiable, achieving a unity of governance effectiveness and the rule of law principle.
