Governance of a Nation Must Begin at the Village Level: The Tradition of “Not Passing Conflicts Upward” in Rural Codes and Conventions and Its Modern Significance

摘要: 乡村治理是国家有效治理的基础,乡规民约则是乡村治理的重要工具,承载着“矛盾不上交”的千年治理智慧,与新时代“枫桥经验”形成深度传承与呼应。传统的乡规民约具有特定的生成条件,是统治权力距离、礼法社会、熟人社会与基层精英共同形塑的结果。传统的乡规民约在“众人合议”“调解优先”的理念和基层声誉机制与基层精英的调解行动中发挥着“矛盾不上交”的作用。作为扎根于乡土社会的民间规范体系,传统乡规民约通过“众人合议”的规则建构、“调解优先”的实践原则、熟人社会的信任与声誉机制,以及乡村精英的协调组织,实现了低成本、高认同度的矛盾在地化解。在现代国家治理中,乡规民约经历了传统到现代的转化,起着更为重要的作用,即以乡规民约实现乡村社会关系网络的重构;构建中国传统道德文化与现代精神相融合的乡村治理理念;以培育新乡贤作为盘活乡规民约效能的重要支撑。Abstract: Rural governance serves as the foundation for effective national governance, with rural codes and conventions as its crucial instruments. For centuries, the governance philosophy embodied in the principle of “not passing conflicts upward” has been deeply embedded in this tradition, forming a deep continuity and resonance with the modern “Fengqiao Experience”. Traditional rural codes and conventions emerged under specific conditions, shaped by the distance of ruling power, the ritual-law society, the acquaintance society, and the influence of local elites. Guided by the principles of “collective deliberation” and “mediation first,” and operationalized through grassroots reputation mechanisms and the mediation efforts of local elites, these traditional instruments effectively fulfilled their role in “not passing conflicts upward”. As a folk normative system rooted in rural society, traditional rural codes and conventions achieve localized conflict resolution at low cost and with high recognition through the construction of rules based on “collective deliberation”, the practice principle of “mediation first”, trust and reputation mechanisms in an acquaintance society, and the coordinating organization of rural elites. In the context of modern state governance, it is essential to revitalize the role of these rural codes and conventions through traditional contemporary adaptation: first, by leveraging rural codes and conventions to reconstruct rural social networks; second, by developing a rural governance philosophy that integrates traditional Chinese moral culture with modern ethos; third, by fostering a new class of rural elites to serve as a vital support system for revitalizing the efficacy of rural codes and conventions.
