Criminal Regulation of Insulting Online Violence

As a typical form of online violence, online insult has significant social harm and urgently needs to be regulated by the rule of law to comprehensively protect the legitimate rights and interests of victims. In order to achieve the accurate application of the crime of insult, as a prerequisite, the core characteristics of the key constituent elements of the crime of insult in the context of networking should be clarified, especially the formal and substantive standards for determining the crime of insult should be refined. Starting from typological thinking, it is necessary to distinguish between joint criminal and non joint criminal cases of online insult, and on this basis, further differentiate the methods of perpetrating act determination, causal relationship judgment, and specific imputation schemes. Reasonable standards for decriminalization should also be established, with emphasis on abnormal intervention factors, necessity of legal interests protection, effective victim commitments, and the application of justifiable defense in cases of online insults, in order to avoid excessive expansion of the criminal circle.
