    Abstract
  • The phenomenon of malicious payment with a large number of coins in judicial practice is emerging, which reflects the differences between the practical application of relevant laws in China and the original intention of legislation. The relief of malicious payment with a large number of coins has become an urgent problem. In view of different types of malicious payment with large amounts of coins, this paper analyzes the legal form of malicious payment with large amounts of coins from the perspective of private law and public law, and determines the relief ways in private law and public law. Meanwhile, learning from extraterritorial legislation and improving relevant relief ways can better avoid the occurrence of such acts.
