Abstract

Abstract

According to the different texts of criminal law, cybercrime can be divided into networked traditional crime and specialized cybercrime. This dichotomy of cybercrime shows various differences in the interpretation of criminal law. Traditional cybercrime is more inclined to the theory of infringement of legal interests, substantive interpretation, objective interpretation and expansion interpretation, while special cybercrime is more inclined to the theory of normative violation, formal interpretation, subjective interpretation and limited interpretation. In the misunderstanding of interpretation, the traditional network crime is very easy to overhead the constituent elements. Therefore, it is necessary to use the method of formal interpretation to explain the crime, while the special network crime is easy to ignore the degree of infringement of legal interests. Therefore, it is necessary to explain the crime using substantive interpretation. When interpreting the criminal law of these two types of cybercrimes, we should guard against the misunderstanding of the omnipotent theory of criminal law and take a variety of means to control the harmful behavior of the network.
