Lexical Density and Its Fluctuation: A Study on Multiple English Translations of the Analects of Confucius
WU Guo-xiang
2020, 36(5): 25-32,42.
Abstract(366) PDF(14)
Abstract:
Lexical density in translation (translation LD hereafter)is defined as the average number of English words that have been used to translate one classical Chinese clause.First, translation LD is defined with the external reference to the Chinese original text.Since the definition is not confined by the internal lexical system or grammatical structure of the English language, there is no need to distinguish between content words and function words.Secondly, translation LD can be used to analyse translated clause complexes, translated chapters and whole translated versions, so that different styles of translation are demonstrated.Thirdly, Pound's and Ku's English translations of the Analects of Confucius establish an interval of translation LD, that is,[5.91, 9.13], within which existing English translations of the Analects actually fluctuate. This interval redefines the range of multiple English translations of the Analects and even that of English translation of Chinese classics as a whole.

The Conflict and Cooperation of Intergenerational Care—Based on the Content Analysis of the Parenting Module of Small Wood Worm Discussion Forum
YUAN Tong-cheng
2020, 36(5): 50-57.
Abstract(221) PDF(3)
Abstract:
In the context of individualization, as child care requires a lot of time and energy, it inevitably leads to the reduction of caregivers' ability to "live for themselves".Through the content analysis of the parenting module of the Small Wood Worm discussion forum, the research finds that for the professional and technical personnel just starting work not long ago, they and their father generation both have the desire to "live for themselves", but its realization is limited by both resources and Confucian culture. If "children generation live unilaterally for themselves", "old people live unilaterally for themselves" or"they use different ways to live for children" while sharing child-rearing responsibilities, there will be intergenerational conflicts inevitably. If children generation and parents can change from "living for themselves" to "living for us", a good intergenerational relationship can be estalished. This "living for us" shift may be based on an emotional foundation that "blood is thicker than water", the expectation of reciprocity between child-rearing and the elderly supporting afterwards, or just on account of not having adequate child-rearing resources. As the responsibility of parenting is also a kind of life politics, and the insufficient responsibility taking of subjects outside the family will inevitably squeeze the space for family members to choose their lifestyle, the state and other social subjects should share more burden of child care, thus reducing the burden of family members, to increase their capacity to choose more colorful life style and promote family development.

On Protection of Shareholders' Term Interest: Based on Article 6 of the Summary of Civil and Commercial Judicial Work of National Courts
LIANG Ze-yu
2020, 36(5): 67-73.
Abstract(435) PDF(5)
Abstract:
The Supreme People's court stipulates that shareholders are vested term interest for the undue capital contribution. This article points out that, after the reform of the full subscription, the signal function and guarantee function of registered capital have become void and creditors no longer appraise the company's solvency in accordance with the registered capital. In addition, protection mechanisms for creditors, such as guarantee, are widely used, and the smoothness of bankruptcy proceedings is constantly improving. Thus, non-accelerated-expiration are able to protect the term interests of shareholders, and, at the same time, do not excessively damage the interests of creditors. The interpretative course adopted by Supreme People's court could be summarized as the Theory of Legal Guidance.Since the company law clearly authorizes the duration of capital contribution to be agreed by the shareholders and the parties themselves, the creditors have the obligation to review the provisions concerning the duration of capital contribution in the articles of associations and shall not infringe the shareholders' term interest.

ZHOU Zhi-bo
2020, 36(5): 74-83.
Abstract(290) PDF(6)
Abstract:
Cross regional public emergency is a new type of public crisis, and improving the horizontal government coordination legal system is the basic way to deal with the cross regional public emergencies in the future. At present, there are some problems in the governance of cross regional public emergencies, such as the relatively weak concept of emergency, the dispersion of emergency subjects, and the fragmentation of emergency resources.Among them, the root cause is insufficient legal supply,it is mainly manifested in the following aspects:the coordination mechanism between governments is not perfect, the effectiveness of emergency agreement is not perfect, the resource sharing mechanism is not smooth, and the interest compensation mechanism is not mature.Based on this, the state must strengthen the supply of legal system around the emergency response law, give local governments the right to coordinate in legislation and clarify the operating rules of intergovernmental coordination agencies; strengthen the construction of good faith and equal consultation, give the emergency agreement legal effect; improve the sharing mode of emergency resources among governments, and establish a cross regional resource collaborative allocation and emergency information sharing mechanism; respect the autonomy of the assistance subject, through the job assistance cost mechanism and the cross-regional emergency financial transfer payment mechanism to ensure the initiative and fairness of intergovernmental emergency assistance.
The Trial Avoidance Effect of Guilty Plea
CHI Da-kui
2020, 36(5): 84-90,97.
Abstract(280) PDF(2)
Abstract:
This paper adopts normative analysis method to study the procedural effect of guilty plea. The concept of "guilty plea" in Chinese context has two meanings, including guilty confession and guilty plea. The procedural effect of a guilty plea is to avoid trial, whereas a guilty confession can only simplify the trial. In other words, whether "admission charge" will have the legal effect of evading trial directly determines whether there is a true guilty plea in our country, and the procedure of quick adjudication is a typical example of evading trial. The way to avoid the trial is to obtain the guilty plea through the negotiation procedure, solve the conviction and sentencing, eliminate the dispute points, and finally ensure the binding force of the guilty plea agreement on the judge.Circumvention trial follows an efficiency-oriented approach of consequentialism, that is, although circumvention of trial, it should achieve the same effect as trial, so as to establish a new balance between crime control and due process in the criminal justice system.

LANG Shuai
2020, 36(5): 98-105.
Abstract(332) PDF(2)
Abstract:
International cooperation is necessary for the governance of infectious diseases in the era of globalization.Since the middle of the 19th century, international cooperation of infectious diseases has gone through three stages:the rise and preliminary exploration from 1851 to 1947, the integration and rapid development from 1948 to 2002, and the reform and structural adjustment from 2003 to the present. At present, it still faces many challenges, such as the "non-cooperation problem" at the unit level, the "cost-bearing problem" of international public goods, the "South-North gap" in national governance capacity, the "cognitive dilemma" at the conceptual level. In the future, efforts should be made to deepen the reform of the mechanism to fully reflect the needs of emerging powers and developing countries; seize the key links and strive to build the core capabilities;rationalize various relationships and clarify the key directions; attach importance to case studies and disseminate successful experiences from the emerging powers.
