Abstract:
A service invention is made by an employee in performing his or her duty and under the sponsorship of the entity he or she is working with. Such invention creation involves two kinds of legal relationship, i.e., labor contract relationship and service invention relationship between the employee and his or her entity. Such service invention relationship is established on the basis of the labor contract relationship and in performing his or her duty to his or her entity. However, his or her invention can be the results using the material and/or technological means of his or her entity but independent of his or her service and his or her labor contract but representing his or her own will. In this respect, the right to apply for the patent of this invention and the patent shall be owned by the inventor or designer himself or herself. Article 6 of Patent Law in force violates the equitable principle in respect to the rights between the two civil subjects. It will be hard for Article 6 to be effective and the objective of the Patent Law to be realized. This text is a proposal of legislative amendment to this part of the Patent Law after a study of the Patent Law in comparison with relevant foreign laws.

Abstract:
The Tea House is one of the dramatic patterns with daily conversation and great narration perfectly blended. From the viewpoint of the daily conversations among “the old Beijing”, Laoshe developed the daily conversations towards great narration by elaborating them artistically. The Tea House reveals Laoshe's hard pursuing artistic perfection in the context of prevailing political utility and it also suggests Laoshe's artistic ability in the 1950's and 1960's when the literature was featured with political sense. The Tea House provides a perfectly good text for us to appreciate the aesthetic judgment and the narrative style of the literature during the 17 years after the founding of our country.

Dolgun was an outstanding statesman and strategist in the early Qing Dynasty. When he acted as regent, he recified the official style of work, remitted three pays, prevented the increment in tax of the posts, and reestablished the rules of taxes and corvee. All these measures he adopted took a decisive effect on eliminating the long-standing abuse in the last years of the Ming Dynasty, getting rid of the corrupt customs in the earlier Hu Dynasty as well as consolidating the political power of the Qing Dynasty. And these steps he adopted were still of great significance on laying the foundation of the Qing Dynasty.

The paper analyses the change of compulsory education policies since 1977 and practical issues of current Chinese education, disparities among primary schools and secondary schools, the trend of education for examination, heavy burden of pupils, school choice and miscellaneous fees, and rural education, etc. Three dilemmas, education for examination and all round education, the principles of compulsory education and charging fees, and education for the minority and education for all, are discussed. It is argued that dealing with the three dilemmas would be critical to the development of compulsory education in the new century.
