On the Critical Legal Studies of International Law

摘要: 国际法批判法学派是晚近出现的国际法理论,该学派的主要特征是对当代国际法理论的所持的批判立场,他们通过解构传统的国际法理论,特别指出了其中所存在的结构性缺陷和矛盾。他们特别注重权力和政策的重要作用,认为国际法律概念反映了特定的权力关系。他们还主张由于不存在普遍意义的基本国际法规范,应对并无共同基础的国际法规则分别加以考察,具体问题具体分析。Abstract: Critical Legal Studies is a “New Stream” in international law research.Through analyzing the Indeterminacy and incoherence of the liberal ethical basis of international law,the theorists of Critical Legal Studies maintain that there is not a general norm in intemational law,and the conception of traditional public international law seems unable to construct an adequate vision of international social life,so it is necessary to analyze the international law norms individually.
