A Study on the Character of China's Country Village Committees——From the Perspective of Law Status

摘要: 我国村委会数量众多,村委会行政职能定位问题日显突出,导致实践中遇到诸多法律问题,而问题的产生与村委会的法律地位在法律上无明确而详细的规定密切相关。作者在当前“三农”政策的背景下,从法律地位的角度对我国村委会的组织性质进行考察。文章认为,我国存在自治组织与基层政权的冲突和行政主体与非行政主体的冲突,应当引起重视。Abstract: China's large number of committees and the committees on the legal status of the law without clear and detailed requirements in practice led to many legal issues. The author, under the current "three agricultural" policy background, study the committees from the legal status of the concept The article holds that conflicts exist letween the autonomous organizations and grass-roots power of the main conflict and administrative and non-administrative subject, which deserve attention.
