On the Shortage of Migrants' Rights and Sociology Analysis of Their Crimes

摘要: 保障流动人口权益,防治流动人口犯罪,离不开城市的发展、政府的管理、法律法规的健全与落实以及社会力量的监督与支持等四个方面所构成的外部环境。但是在实践中,存在着城市的发展往往忽视流动人口的权益,地方政府在对待流动人口的目标、利益与责任上存在冲突与矛盾,法律的合法性主张与事实的有效性之间存在着较大差距,有效的社会力量的监督和支持缺失等一系列问题,结果导致各系统之间的互动关系存在阶裂现象。保障流动人口权益及防治其犯罪,最重要的是政府真正树立以人为本的执政理念,在四个子系统之间构建良性的互动关系,切实保障流动人口的权益,从根本上防治流动人口犯罪。Abstract: Guaranteeing the migrants' rights and preventing their crimes depend on the exterior environment. Nevertheless, there is a series of problems in practice, such as: the development of cities often ignores the migrants' rights; the local goverment have con-flicts between considering migrants' rights and their own responsibilities, etc. It results in the rank gaps between the interactive sys-tems. It is important for the government to set people-oriented ruling concept to guarantee the migrants' rights and prevent potential crimes.
