    摘要
  • 摘要: 法治具有稳定性，而人治不具有稳定性，但是不管人治或者法治，其作用都依靠人的运作才能实行。人治与法治的运作者是人，治理对象也是人，何以一种方法不具有稳定性，而另一种方法具有稳定性呢?本文试图从政治理论建构的预设前提分析其合理性基础，从而揭示出法治具有稳定性而人治不具稳定性性的内在机理。

     

    Abstract: There is stability in the rule of law while not in the person's management. However, both the rule of law and the person's management depend on people. Then why is there stability in the rule of law and no in the person's management? This text tried to analyze the rationality of the premise of the two political theories and disclose the inside reason.
