  • 摘要: 英美法系认为教唆犯罪的本质是试图引诱他人实施犯罪。与大陆法系和中国刑法中的教唆犯不同,英美法系中的教唆犯罪并不是共同犯罪研究范畴内的问题,而是不完整犯罪研究范畴内的问题,因此英美法系中的教唆犯罪的主、客观要件有很多独特的问题。

     

    Abstract: The Common Law System believes that the nature of solicitation is to induce the other person to commit a Crime.Solicitation in the Common Law System falls into the category of inchoate crime.Therefore,in the Common Law System,a large number of peculiar problems are attached to the studies of Mens Rea and Actus Reus of solicitation.
