摘要: 根据海瑞定理,在处理疑案时,应力争将预期错判损失与证明成本之和最小化,并严格按照符合社会强势观念的预设规则执法以降低当事人不服判决造成的成本,而现代司法制度中的证明责任制度正是海瑞定理在制度层面上的建构与拓展。Abstract: Based on the theorem of Hai Rui, when we handle the disputed case, we should strive to minimize the loss of expected misjudgement and the cost of provement, and we must enforce the law strictly in accordance with designed rules which is consistent with social strong concept in order to reduce the cost caused by any party dissatisfied with decision.The system of the proof burden in modern judicial system is construction and development of Hai Rui theorem in the system level.
