    摘要
  • 摘要: 移管外国被判刑人应遵循有利于被判刑人、相互尊重主权和管辖权两项原则。移管须具备以下五个条件:执行国必须是被判刑人的国籍国或居住国、依执行国的法律被判刑人的行为业已构成犯罪、被判刑人仍有一定的刑期需要执行、移管所依据的必须是判刑国的生效判决,并且不存在尚未完结的申诉程序、必须获得被判刑人或其法定代理人的同意。移管应按下列程序进行:征得被判刑的外国囚犯的同意、提出移管被判刑人的请求、审查请求国的移管请求并作出决定、就有关移管具体事宜进行磋商安排、继续执行判决。

     

    Abstract: Transfer and jurisdiction the sentenced foreigners shall follow two principles:benefit the sentenced foreigners and respect state sovereignty and jurisdiction. This article gives a research on the conditions and procedures of the transfer and jurisdiction fully and accurately.
