Morality and Law in the Context of Early Civilization: From a Comparative Perspective of the Political Culture

摘要: 中西早期文明语境中,道德与法律虽在产生上有先后之分,在本质上有自律他律之别,但从秩序提供和规范确立的角度,两者基本上是和谐统一、混而不分,同时相互渗透,共同作用。德法相容是早期文明的共性,突出表现为道德的法律化。中西道德与法律关系也有较大的差异性,价值文化、个性行为、经济形式、个人与社会的关系是导致差异产生的重要因素。早期文明语境中道德与法律关系的探讨仍能为审视当代两者关系提供有益借鉴。Abstract: In western and Chinese early civilization, morality and law are produced in a separate, autonomically and heteronomously in essence, but in the angle of providing order and establishing regulation, both basically are harmonious and unified, mixing without same, at the same time, permeating each other and acting jointly.The compatibility of the morality and law is in common in the early civilization, especially in the legalization of morality.There exists big difference between the morality and law in western world and China.These, cultural value, personal behavior, economic form, the relation between individual and society, are the important factors causing the difference.The study of the relationship between morality and law in early civilization will provide useful reference for examining the contemporary relationship between them.
