Abstract: Pending custody necessity censorship is a system of taking a prudent attitude and strict legal control for post-sentence detention in criminal procedure as well as the important embodiment of national respect and safeguard human rights. Review of pending custody necessity contains prior review and post review. Subjects and initiating subjects of review of pending custody necessity are different under different circumstances. The standard of pending custody necessity review is the key to the censorship, and the full participation by defense lawyers is necessary guarantee of the censorship.
