On Procedure of Saving Evidence from Damage

摘要: 证据保全程序是基于客观上的急迫需要,在正式开展庭审调查前就特定证据材料预先加以调查,以便对其证据的形式与内容加以固定、保存的一种特别程序。文章探讨了证据保全的范围、条件、管辖、程序、效力,并提出了若干立法建议。Abstract: Procedure of saving evidence from damage results from objective and exigent need of the parties or suits. Court investigates evidentiary material, and fix up and save both form and content of evidence in such procedure.
