    摘要
  • 摘要: 真实义务在民事诉讼中的确立是适应诉讼观的变化和诉讼日趋复杂化的需要。真实义务作为法院适度干预当事人诉讼行为的过滤器,可以促进诉讼活动按照立法者的意图运作,并且有助于建构一个为法官提供裁判基础的诉讼资料之净化的制度环境。

     

    Abstract: Forming the Obligation of truthfulness in the civil procedure is in order to meet the need of complexity and change of lawsuit.As a filter for the court to propeny interefere the litigant's behavior,Obligation of truthfulness can promote the lawsuit action operating according to the intention of lawmakers; moreover it can help to form a system environment,in which,the judges can distinguish the truthfulness of the lawsuit material,which is a foundation of judgement.
