The Sources of Arbitrator’s Duty to Apply Antitrust Law Ex Officio

摘要: 适用反垄断法不仅是仲裁员所享有的权力,而且也是其应承担的义务。仲裁员适用反垄断法的义务既可能来源于当事人的要求,也可能源于一国法律的规定,还可能源自是国际商事仲裁制度发展的需要。虽然仲裁员依职权适用反垄断法的义务常因与国际商事仲裁若干特点抵触而备受质疑,但这并不能改变仲裁员依职权适用反垄断法义务的存在。问题的关键在于仲裁员在依职权适用反垄断法时如何遵守国际商事制度中的其他重要原则。Abstract: Arbitrators undoubtedly have a duty to apply antitrust law, and are expected to do so by the intention of the parties, the legal demanding of relevant private international law and the requirement of sustainable development of international commercial community. The duty of arbitrator to apply antitrust law can extend to the application of antitrust law even ex officio, provided the basic principles of international commercial arbitration, such as the party autonomy, due process and right to be heard and be treated equally, have been faithfully respected.
