Combination of Lenience and Strictness--Orientation of the Legislation of Crime by Taking Advantage of Duty Under the Harmonious Society Context

摘要: 在打击职务犯罪过程中贯彻宽严相济刑事政策是构建和谐社会的题中应有之义。我国现行的职务犯罪立法存在着贪污罪构成标准过高、渎职罪成立条件过严、贿赂罪法网设置过松及死刑作用之夸大、资格刑功能之错位、罚金刑地位之缺失等宽严失调的现象,故必须从立法降低贪污罪的构成标准、放宽渎职罪的成立条件、严密贿赂罪的法网设置及废止死刑、改造资格刑、增设罚金刑等。Abstract: To implement the policy of combining lenience and strictness in the process of crackdown on crime by taking advantage of duty is an important method in buiding a harmonious society. There are some imbalance in the present legislation of crime by taking advantage of duty, such as high standard of corruption crime, strict conditions of crime of dereliction of duty, etc. Therefore, some countermeasures must be carried out.
