摘要: 文章明确了物权变动的三大主义与两大区分原则,指出可以用“物权行为”指称一些物权法上特有的行为,坚持我国民法不采纳物权行为理论的立法选择,但也肯定对物权行为理论的研究有一定价值。Abstract: The article first discusses the theory of juristic acts of real rights as a whole. Then it gives a concept to the acts of real rights. In the third part, the article points out the merits and demerits of the independent and abstract nature of juristic acts of real rights. Finally, the article insists that the civil law of China should not accept this theory.
