Legal Constrains and Recommendations on the Private Fund Raising Activities of SMEs

    摘要
  • 摘要: 目前我国中小企业的民间融资活动面临法律地位不确定、相关法律规范零散且相互冲突、法律监管乏力等诸多法律困境。目前克服这些困境的途径主要有：加快制定民间融资法，明确合法民间融资与非法民间融资之界限，健全中小企业民间融资法律监管机制，完善中小企业民间融资征信法律体系等。

     

    Abstract: The fund raising activities of SMEs are faced problems of undetermined legal status, few relevant status and regulation available with some conflicts among them.Recommendations to solve the problem discussed in the paper include introducing laws on it, clearing the distinction between legal and illegal fundraising, establishing effective supervising mechanism and company crediting system, etc.
