Analysis of Subjectivity on Process of Judicial Provement

摘要: 诉讼证明过程是一个主观判断过程,法官对事实的认定有很大的主观性。法院裁判所达到的真实是法律真实,要求客观真实是不切实际的。为了保障诉讼主观证明的客观化,应当以提高法官素质为前提,承认法官自由心证的存在,完善举证责任规则,防止法官职权的滥用,以确保司法公正。Abstract: Judicial Provement is a Subjective Process of Judgement. Judges cognize facts of suit fairly subjectively. Court's Judgements only reach law reality, not objective truth. To insure the impersonality of judgement, we should advance judge's qualification and admit that judges have the right to verdict evidence freely.
