On the Collateral Obligation and the Safety Guarantee Obligation

摘要: 虽然附随义务与安全保障义务具有功能上的相似性，在特定情况下也会发生竞合，但二者具有不同的适用领域，实践中应注意区分。通过对附随义务和安全保障义务概念、关系的简要分析，以期对司法实践中相关案件的处理有所裨益。Abstract: Although the collateral obligation and the safety guarantee obligation have the same functions and coincide sometimes, they are applied in different areas.We should distinguish them in practice.The paper makes discussions on their concepts and relationships for providing some references in the jurisdiction.
